Garmey Law has filed a lawsuit against Palace Playland following a serious injury involving a child on the Super Star ride at the Old Orchard Beach amusement park in 2022.

The lawsuit alleges that failures involving ride restraints, employee training, supervision, and safety oversight contributed to the incident and resulting injuries.

Lawsuit Raises Questions About Ride Safety and Oversight

According to the lawsuit and publicly reported findings from the Maine Office of State Fire Marshal, the incident occurred in July 2022 when a child was injured while riding the Super Star attraction.

The lawsuit alleges that the child’s safety restraint was not properly secured before the ride began moving. The child fell from the ride area and sustained serious injuries.

A subsequent investigation by the State Fire Marshal’s Office examined the circumstances surrounding the incident. According to reporting on the investigation, the ride operator did not ensure that all passengers were properly secured before the ride began.

The lawsuit raises additional allegations involving employee training, supervision, management oversight, and the safety procedures used to protect riders.

The complaint also emphasizes the lasting impact of the incident and the importance of accountability when safety procedures are not followed.

“The harm did not end when the machinery stopped. This lawsuit asks Palace Playland to answer for the full human consequences that flowed from starting the ride before this child was properly secured, and to help ensure that no other family is placed in the same danger.”
