[Bangor, Maine]: The legal team at Garmey Law is proud to announce that a case we feel passionately about was recently highlighted in Bangor Daily News. In June of 2020, Alexandria Orduna, 23, sued the U.S. Department of Health and Human Services (DHHS), which administers Medicaid. She is demanding payment for negligence surrounding her 2 ½-year-old’s ongoing medical care. A federal judge has allowed the Maine negligence lawsuit to move forward against the child’s medical providers regarding her claim that they failed to report her son’s signs of abuse to state authorities.
Alexandria Orduna’s child was abused by her ex-boyfriend. Her son suffered brain injuries as a result of a skull fracture and was left blinded and severely injured. The medical professionals at Brewer Medical Center did not inform her about the signs of abuse, nor did they report the suspected abuse to Maine authorities as it is required by law.
While the legal representation of the federal DHHS attempted to dismiss our client’s complaint, they were unsuccessful as the lack of a formal abuse report is a “breach of the standard of care for medical providers.” The Maine negligence lawsuit will be moving forward to trial. The criminal case against Alexandria Orduna’s ex-boyfriend, Cyree Hansley is pending at the Penobscot County Judicial Center. He has pleaded not guilty and is free on bail for two counts of aggravated assault and one count of assault on a child less than 6 years old. His case will be handled separately and has been delayed as a result of the pandemic.
